Privacy Notice for Job Applicants and Candidates for collection, use and disclosure of Personal Data

Lotus Mattress Co., Ltd., and its affiliated (“We”/“Us”/the “Company”) respect the privacy rights of of job applicant, candidates (“you” or “your”), and ensure that your personal data is protected. This Privacy notice describes how we collect, use and disclose (“Processing”) your Personal Data during recruiting and job interview process, either submitted as part of the online application and/or through alternative channels i.e jobsdb, JOBTOPGUN and tells you about data protection rights in relation to your Personal Data in connection with recruiting procedures  as required by the Personal Data Protection Act, B.E. 2562 (2019) (“PDPA”), as follows:

  1. Collection of Personal Data

  1.1 Information as specified in the job application form, as follows:

(1) Your Personal information or information according to the documents that you provide to the Company such as Resume, Curriculum Vitae (CV), job application, full-name, age, signature, your picture, height, weight, date and place of birth, gender, nationality, religion, marital status, military service.

(2)  Contact detail such as address, e-mail address, telephone number, social media information.

(3) Details of your family such as full-name, age, occupation, telephone number of your spouse, father, monther and children etc.

(4)     Details of reference person and person to notify in case of emergency.

(5) Information about your education, abilities and other qualification such as education level, qualifications, institution/university, educational history, training history, academic results, test results, professional qualifications, language abilities and other abilities and information from references you have provided to the Company.

(6) Work experience and pervious employment such as employment data, start date/last date, position, training history, Cerfitication of unemployment, Cerfitication of employment, salary.

1.2   Identity documents: information on govermant-issued such ID card, driver’s licenses and copies of documents issued by government or private agencies, such as copies of house registration, certificates, degrees, academic transcripts, marriage or divorce certificate, name or surname change certificate, militaty certification, tax information, social security information, passport and work-permit (only foreigner)

    1. Other information such as information that you share and disclose through our interview.
    2. Other information necessary for recruiting and selecting employees, taking care of welfare benefits, analyzing and managing our work, and complying with related laws.

1.5    In the event that you are selected to be an employee, we will collect additional personal data as set out in the Employee Privacy Policy.

2.   Purposes of collection, use and disclosure of your personal data.

  2.1     In order to apply job with us, by carrying out the recruitment process, checking qualifications, selecting before making an employment contract.

  2.2    For our legitimate interests, such as analyzing and creating a database, managing and improving the recruitment and selection process, job-related news, preparing employment contracts if you are selected.

  2.3     To prevent and suppress dangers to the life, body or health of you or other persons, such as emergency contact, control and prevention of infectious diseases.

  2.4     Comply with the laws.

  2.5     To protect the personal information

  2.6    To achieve the objectives according to the consent you have given, such as consent to send your job application to Group companies.

  1. Sensitive personal data

  3.1 We may need to collect and process of your sensitive personal data for the purposes as set out in this Privacy Notice.

    1. 3.2.We may need to process of your sensitive personal data, details as follows;

(1) Health and medical data such as chronic health conditions, colour blindness, blood type, medical history and the information contained in a doctor’s certificate/medical certificate for purposes of evaluating the respective suitability of applicants and information on disability for purposes of recruiting.

(2) Biometric data such as facial recognition is used to identify and verify your identity, prevent crime, and protect legitimate interests.

(3) Information regarding criminal history in order to consider suitability for employment

(4) Religious beliefs, philosophies, race, nationality, disabilities, trade union information, genetic information, biological information for the purpose of providing facilities, activities and welfare that are appropriate for employees, including for use in managing the care of employees in a way that is equal and fair in accordance with human rights principles.

(5) Other information of personal data for lawful purposes, such as to prevent or suppress dangers to life, body or health of a person in cases where you are unable to give consent, information that is disclosed to the public with your express consent, to exercise legal claims, and to achieve objectives related to labor protection, social security and employee welfare.

    1. 3.3. If necessary, we will only process your Sensitive Personal Data with your specific consent or for other purposes required by law. We will use our best efforts to provide adequate security measures to protect your Sensitive Personal Data.
    2. 3.4. Information regarding criminal history, which will be collected from evidence that you provide or that you consent to be examined by the authorities with legal authority, we will provide measures to protect such information as required by law.

 

  1. Data Retention

In case of you have been chosen to work with us, we shall retain your information for the duration of your employment and for a period of ten years after termination for information related to our legal requirements.

If you are not chosen to work with us, we will keep your information for 30 days from the date of interview result annoucement.

If we use your personal data with your consent, we will process such personal data until you have withdrawn your consent and we have completed your request. However, we will retain your personal data only as long as it is necessary to maintain a record of your withdrawal of consent, so that we can respond to your future requests.

We have a monitoring system in place to delete or destroy personal data after the retention period has expired or when it is no longer relevant or necessary for the purposes for which the personal data was collected.

 

  1. Transferring Personal Data Overseas

   5.1 We may send or transfer your personal data to our affiliates or other persons in a foreign country if it is necessary in order for us to perform our obligations in the contract to which you are the counterparty or contract between us and third party for your benefit, to respond to your pre-contractual request; to protect your and third party’s life, body and health, to comply with laws or to the extent necessary for the public interest activities

   5.2 We may store your information on a computer, server, or cloud provided by a third party and may use
third-party programs, applications and platforms in processing your personal data. However, we will not allow unrelated parties to access to your personal data and will require such parties to have appropriate security protection measures.

   5.3 In the event that your personal data is transferred to a foreign country, we will comply with applicable personal data protection laws and take appropriate measures to ensure that your personal data is protected and you can exercise your rights in accordance with the laws. Moreover, we will require those who receive the data to have appropriate protection measures for your personal data, to process such personal data only as necessary, and to take steps to prevent unauthorized use or disclosure of your personal data.

 

  1. Your right as a Data Subject: subject to applicable laws and exceptions thereof, you may have, as followes;

We will take your request to exercise your rights into consideration and get back to you as soon as we can.
The PDPA act is compliant with the aforementioned rights.
